A panel for larger text or higher contrast does not establish that somebody can choose a product, complete a form and place an order. Before buying an accessibility overlay, ask for evidence of the barriers it removes. An automatic-compliance promise is not a finding from testing your website.

## What does an overlay change?

An overlay usually adds code that changes the page in the visitor’s browser. It may offer display preferences or alter individual elements. That is different from repairing the original template, content or order process.

There is no need to claim that a script can never fix a label or behaviour. Test whether the particular change is correct, which barriers remain and whether the whole task works. Ask for a comparison with the overlay enabled and disabled, including the assistive technologies covered by the claim.

## What the accessiBe case establishes

In April 2025 the US FTC approved a final consent order concerning accessiBe. It restricts misleading claims that accessWidget makes any website WCAG-compliant. The FTC also addressed paid reviews presented as independent. This is a specific case, not a ruling on every product in the category.

Ask the supplier what evidence supports its promise and which scope it covers. Do not treat the US case as a determination of your business’s European duties. Equally, do not take a website badge as proof that legal risk has disappeared.

## How to check the actual result

Before buying, ask for a demonstration of one complete important task:

- Can every control be reached with a keyboard, with visible focus?
- Are field names, error messages and reading order understandable?
- Can the task be completed with a screen reader, including external steps?
- What remains unfixed, who will repair it and how will it be checked again?

W3C describes WCAG testing as a combination of automated checks and human evaluation. Conformance concerns full pages and complete processes. A tool score or list of automatic repairs does not replace checking the entire user journey.

## What lawsuit and testing statistics mean

A count of lawsuits against sites with overlays does not itself show that the overlay caused the suit. That conclusion would require examination of the method, sample and actual claims. Detection percentages need the same care: studies may count different things.

For your decision, ask for identified barriers, the test scope and remaining limitations. Do not turn somebody else’s percentage into an estimate of exactly how much remains to fix on your site.

## Why ErgoStrat does not sell an overlay

A Digital Accessibility Review does not end with a recommendation to buy an overlay. If one is already installed, we record it as a risk, not a point in the website’s favour. We check key pages with a keyboard and screen reader; a settings panel does not remove those checks.

Nothing on the website changes while we review it. Remediation is separate work after the report. The findings let you commission specific changes, rather than select software on a promise of full compliance.

## Questions

### Can an overlay be a temporary solution?

Ask for evidence of the barriers it removes and those that remain. Do not treat it as protection from a complaint or lawsuit. Compare the proposal with specific repairs to identified barriers, without assuming either option must cost less.

### Does a corner icon mean an overlay is installed?

It is a reason to check, not a certain diagnosis. Ask which tool runs, what it changes and what data it receives. A settings panel alone establishes neither full conformance nor complete inaccessibility.

### Does one legal case decide the question for every supplier?

No. Examine the particular product, claim and decision. For the technical choice, request verifiable results on your site. For legal consequences, establish the applicable duties rather than relying on a sales-page promise.

## See what actually does not work before you buy an overlay.

Before buying an overlay, see what actually does not work. A Digital Accessibility Review checks the key pages by hand with a keyboard and screen reader. It shows which barriers to fix first before you spend on additional software.
